Gromby provides:

• AI-powered voice and chat receptionist demonstrations personalized to your business
• Secret Shopper Call service (mystery shopper calls, recordings, and performance scorecards)
• Phone Revenue X-Ray website analysis reports
• Related phone handling training materials (Phone Fix Checklist, Phone Script Vault)

To use certain features, you must provide accurate and complete information including your name, email address, company name, and business website URL. You are responsible for maintaining the accuracy of this information and for all activity under your account.

Certain products are available for purchase through the Service, including the Secret Shopper Call and optional add-ons. All prices are displayed in US dollars. Payments are processed securely by Stripe. By making a purchase, you agree to pay the applicable fees.

Refund Policy: We offer a 30-day satisfaction guarantee on all purchases. If you are not satisfied with the service, contact us within 30 days of purchase for a full refund. Refund requests should be sent to support@gromby.com.

By purchasing the Secret Shopper Call service, you agree that:

• You have the authority to authorize mystery shopper calls to the business phone number provided (your own business).
• Our AI agent will place up to 3 calls at various times (business hours, after hours, overnight) to test phone handling performance.
• Calls are recorded for analysis and scorecard generation.
• Recordings and transcripts will be delivered to the email address associated with your purchase.
• Call recordings are retained for 90 days, after which they may be deleted.

Competitor Spy Call Add-On

If you purchase the Competitor Spy Call, you represent that you are providing the competitor’s publicly listed business phone number for legitimate business intelligence purposes. We will place a single mystery shopper call to that number. You are responsible for ensuring your use of this service complies with applicable laws.

We generate personalized AI voice and chat demos using publicly available information from your business website. The demo is for demonstration purposes only and does not represent a production-ready product. Demo interactions (calls and chats) may be recorded for quality and product improvement purposes.

By submitting your website URL, you authorize us to access and extract publicly available information from your website to generate your personalized demo and analysis. We only access publicly available content. We do not access password-protected areas, private databases, or non-public content.

You agree not to:

• Use the Service for any unlawful purpose
• Provide false or misleading information
• Interfere with or disrupt the Service
• Attempt to gain unauthorized access to any part of the Service
• Use the Service to harass, spam, or harm others
• Resell or redistribute the Service without our written consent
• Submit phone numbers you are not authorized to have called (for Secret Shopper or Competitor Spy services)

The Service and its content, features, and functionality are owned by Gromby LLC and are protected by copyright, trademark, and other intellectual property laws. Scorecards, reports, and training materials generated for your purchase are licensed to you for personal business use only.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

AI-generated content (demos, scorecards, X-Ray reports, recommendations) is for informational purposes only and should not be relied upon as professional advice. Revenue estimates and scores are approximations based on available data and industry benchmarks.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, GROMBY LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APPLICABLE SERVICE IN THE PRECEDING 12 MONTHS.

You agree to indemnify and hold harmless Gromby LLC and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any third-party rights.

We may terminate or suspend your access to the Service at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will immediately cease.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Delaware.
